Lucknow: In the petition filed by suspended IPS officer Amitabh Thakur in Lucknow bench of Allahabad High Court, the UP government assured the Court that if the FIR against Mulayam Singh Yadav has not been registered so far in compliance of CJM Lucknow order, it shall be registered today.
After that the bench of Chief Justice Dr D Y Chandrachud and Justice S N Shukla disposed of the petition by Mr. Thakur and his activist wife Dr Nutan Thakur with prayer to constitute a Judicial Commission to enquire into the role of various senior officers in harassing them illegally.
The Court said that it is premature at the moment to constitute Judicial enquiry against Chief Secretary Alok Ranjan, DGP Jagmohan Yadav and others, but at the same time it directed the State to observe both procedural and substantive fairness with an officer of the Indian Police Service.
The Court said that the State must understand that it is amenable to judicial scrutiny and in a case related with officer of the Central services, the Court will not be powerless to intervene, if material comes for unfair treatment.
The Court said it would expect norms of fairness and proper procedure to be observed at every stage, saying that Amitabh can always approach the Court if he feels his fundamental rights have been infringed.
